Living Trust:
Living trusts only serve one purpose: They allow you (the settlor) to transfer your trust assets after your death without the court supervision of a probate proceeding. A living trust is only used for estate planning and a way to avoid probate. You have control over your estate, your finances, your healthcare, and your money, until you can't.

A living trust, a will, a durable power of attorney for finances, and advanced health care directives.

You are the settlor, and you create the trust. The trustee is the person who manages the assets once they are in the trust. The successor trustee is the person who takes over as the trustee at your death, and the person that transfers trust property to the beneficiaries you named in the trust. Beneficiaries are the ones that take over your assets once they have been distributed.
Probate:
Probate can take up to 18months to go through Court proceedings. Probate costs is based on the value of the assets in your estate. Probate attorneys are costly. It's stressful for your family, especially if they are grieving your loss. In-family fighting over distribution might occur if assets are not in a living trust. You have to wait for a Judge to supervise the distribution and the cost can be more than $30,000.
